The BULQ Breakdown $200 Case Giveaway (the “Giveaway”) is sponsored and administered by Optoro, Inc., 1001 G St NW, STE 12, Washington, DC 20001 (“Sponsor”).

HOW TO ENTER: Participants enter the Giveaway by doing all of the following things: (1) subscribing to BULQ Wholesale on YouTube; and (2) commenting your best tip for marketing your business during the holiday season on Wednesday, October 27, through October 31, 2021 . Participants will be entered only once.

Participants of the Giveaway may also enter via an Alternative Method of Entry (“AMOE”) submitted by a mail-in entry via U.S. Mail during the Promotion Period as follows:

1. a) Hand print your name, complete address, and a written statement of their predicted top-selling summer item either on a postcard or on a separate piece of paper no larger than 8½ x 11 inches; and
2. b) Mail the postcard or paper in an envelope with the proper postage affixed to: Courtney Herb, Attention: “BULQ Breakdown $200 Case Giveaway; 1001 G St. NW  STE 12 Washington, D.C. 20001. Limit one (1) entry per stamped envelope. Mail-in entries must be received by Sunday, October 31, 2021.

ELIGIBILITY. The Giveaway is open to residents of the continental United States who are 18 years of age or older as of the Entry Period (defined below) (“Participant”). Employees of Sponsor, Sponsor’s advertising and promotion agencies, and their immediate family members and/or those living in the same household of each are not eligible. This Giveaway is void where prohibited or restricted by law. All federal, state, and local laws and regulations apply. No purchase necessary to enter. Only available where BULQ ships (see Terms of Service [https://www.bulq.com/terms-of-service]).

PRIZE. One (1) winner will receive one (1) BULQ case up to $200 in listed price (excluding shipping price, processing fee, and tax if applicable).

DISCLAIMER. BULQ will not be responsible for: (a) any late or lost entries; (b) telephone, electronic, hardware, software, network, Internet, or other computer or communications-related malfunctions or failures; any giveaway disruptions, injuries, losses or damages caused by events beyond the control of BULQ by unauthorized human intervention; or (c) any printing or typographical errors in any materials associated with the Giveaway.

ENTRY DEADLINE DATE. All entries for the Giveaway through YouTube must be received on or before Sunday, October 31 at 11:59 PM EST to be eligible to win the prize.

ENTRIES. Entry must be made by the participant. Any attempt by a participant to obtain multiple entries using multiple/different accounts will void that participant’s Entries and that participant may be disqualified. Final eligibility for the award of any prize is subject to eligibility verification by BULQ. The YouTube timestamp will be the official timekeeper for this Sweepstakes.

WINNER SELECTION. One (1) winner will be selected at random by BULQ shortly after the Entry Deadline Date Sunday, October 29, 2021 at 11:59 PM EST . If the winner meets the eligibility requirements and otherwise complies with the terms here and given in the original Instagram post, and provides the relevant information, they win the prize. Winner will be notified by Instagram direct message on or about 48 hours after the random drawing. Winner must respond within 48 hours of notification or forfeit the prize, in which case an alternate winner will be selected. Any winner notification not responded to or returned as undeliverable may result in prize forfeiture.

All giveaway prizes will be shipped directly by BULQ to the winner.

TAXES. ALL FEDERAL, STATE AND LOCAL TAXES ASSOCIATED WITH THE RECEIPT OF ANY PRIZE ARE THE SOLE RESPONSIBILITY OF THE WINNER.

PRIZE SUBSTITUTION. Winner may not substitute the prize for any other prize or for cash, however, BULQ may substitute the prize for any other prize of equal or greater value, in its reasonable discretion, in the event the prize is not available for any reason outside of Sponsor’s reasonable control.

ERRORS AND DISPUTES. Except where prohibited by law, each Participant agrees that any and all disputes, claims, and causes of action arising out of, or connected with, the Giveaway or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the District of Columbia. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, Participant’s rights and obligations, or the rights and obligations of the Sponsor in connection with the Giveaway, shall be governed by, and construed in accordance with, the laws of the District of Columbia without giving effect to any choice of law or conflict of law rules, which would cause the application of the laws of any jurisdiction other than Washington, District of Columbia.

BULQ is not responsible for any incorrect or inaccurate information, whether caused by website users or by any of the equipment or programming associated with or utilized in the Giveaway or by any technical or human error, which may occur in the processing of submissions in the Giveaway. BULQ assumes no responsibility for any misdirected or lost mail, or any error, omission, interruption, deletion, defect, delay of operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, Entries. BULQ is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of email or players on account of technical problems or traffic congestion on the Internet or at any website or combination thereof. Decisions made by BULQ are final.

CONSENT AGREEMENT: By entering this Giveaway, Participant agrees to be bound by these Official Rules.

GENERAL RELEASE. By entering the Giveaway, you release BULQ from any liability whatsoever, and waive any and all causes of action, related to any claims, costs, injuries, losses or damages of any kind arising out of or in connection with the giveaway or delivery, misdelivery or acceptance of any prize (including, without limitation, claims, costs, injuries, losses and damages related to personal injuries, death, damage to or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light, whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or other theory.

PRIVACY. All participants acknowledge that if they are chosen as a winner, certain of their personally identifying information may be disclosed to third parties at least as required by law, including, without limitation, on a winner’s list. All personal information submitted as part of the Giveaway may be shared by and between the Sponsor and its entities and will use such information in accordance with their online privacy policies.

GENERAL CONDITIONS: In the event that the operation, security, or administration of the Giveaway is impaired in any way for any reason, including, but not limited to fraud, virus, or other technical problem, the Sponsor may, in its sole discretion and at any time, either (a) suspend the Giveaway to address the impairment and then, at the Sponsor’s sole discretion, resume the Giveaway in a manner that best conforms to the spirit of these Official Rules or (b) award the prize from among the eligible Entries received up to the time of the impairment. Any attempt by any person to undermine the legitimate operation of the Giveaway may be a violation of criminal and civil law, and, should such an attempt be made, the Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Failure or delay by the Sponsor to enforce any provision of these Official Rules shall not constitute a waiver of that provision. This Giveaway is in no way sponsored, endorsed or administered by Instagram or similar social media sites. Any information Participant provides in order to enter this Giveaway is being provided to the Sponsor, and not to Instagram, or similar social media sites.

INDEMNIFICATION AND LIMITATION OF LIABILITY: By entering, each Participant agrees to defend, indemnify and otherwise hold the Sponsor and their respective parents, subsidiaries, and affiliated companies, and/ or the agents, officers, directors, and employees of each (collectively, the “Released Parties”) harmless from and against any and all liability of any nature whatsoever arising out of or relating to (a) unauthorized human intervention in the Giveaway by or directed by Participant; (b) breaches of or inaccuracies in any representations or warranties of Participant or any other terms and conditions contained herein; and/or (c) injury, death, or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from Participant’s participation in the Giveaway or receipt or use of any prize, including any such claim by the Released Parties’ employees or agents or any third parties. By entering this Giveaway, each Participant (1) agrees to release the Sponsor and the Released Parties from any and all liability for any loss, harm, damages, costs, or expenses, including without limitation property damages, personal injury and/or death, arising out of participating in this Giveaway or the acceptance, possession, use, or misuse of any prize, (2) waives any and all claims against the Sponsor and the Released Parties based on publicity rights, defamation or invasion of privacy, and (3) acknowledges that the Sponsor has made or are responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to any prize, including but not limited to its quality, mechanical condition, or fitness for a particular purpose. The Sponsor shall be liable for any damages whatsoever related to or arising from (a) any technical errors that may prevent any Participant from participating in any way; (b) unauthorized human intervention in the Giveaway; and/or (c) errors in the administration of the Giveaway. Participant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages. Participant further agrees that in any cause of action, the Released Parties’ aggregate liability for all claims will be limited to the cost of entering and participating in the Giveaway, and in no event shall the Released Parties be liable for attorneys’ fees.
